1. transmission of contract documents
1.1 The Hirer shall receive a booking confirmation upon making a booking. The tenant must send the completed and signed booking confirmation to
by e-mail to office@marie-apartments-muenchen.de.
1.2 For long-term bookings (21 days or more), a deposit of 40% of the rental price is required for the first month at the most. A booking is only binding for both parties after receipt of this deposit.
2. moving in/handover of the apartment
The apartment can be occupied from 14.00 at the start of the tenancy. It is not necessary to make an appointment if you arrive by 7.00 pm
3. extension of the rental agreement
3.1 The booking (shorter than 29 nights) can be extended subject to availability.
3.2 The booking (longer than 29 nights) can be extended with a notice period of 14 days before the end of the booking period. A written request is required in this case.
3.3 The extension shall only come into effect once it has been confirmed to the Lessee verbally or in writing by the Lessor.
4 Cancellation conditions
The total accommodation price is to be understood as the confirmed price for the entire period that Marie Serviced Apartments has held the apartment
4.1 Short-term stays (1 – 30 days):
Cancellation up to 2 days before arrival: free of charge
Cancellation 9 – 3 days before arrival: processing fee € 50: Processing fee 50 €
Cancellation from 2 days before arrival: 100 % of the total accommodation price
4.2 Long-term stays (from 30 days):
Cancellation up to 2 days before arrival: free of charge
Cancellation 9 to 3 days before arrival: 50 % of the total accommodation price
Cancellation 2 days or more before arrival: 100 % of the total accommodation price
4.3 Trade fairs and Oktoberfest:
If canceled up to 4 weeks before arrival: free of charge
If canceled up to 14 days before arrival: 50 % of the total accommodation price
If canceled 13 days or more before arrival: 100 % of the total accommodation price
4.4 Group bookings (4 apartments or more)
Cancellation up to 80 days before arrival: free of charge
Cancellation up to 40 days before arrival: 50 % of the total accommodation price
Cancellation up to 20 days before arrival: 90 % of the total accommodation price
Cancellation 19 days or more before arrival: 100 % of the total accommodation price
4.5 The notice period for early departure is 14 days.
4.6 The customer is liable for non-arrival.
5. payments of rent and services
5.1 The overnight stays and the booked services must be paid in advance, at the latest on the move-in day, to the landlord by bank transfer or by advance payment by credit card (accepted cards are: Mastercard, Visa, American Express)
5.2 In the case of trade fairs and special times, there may be changes to the terms of payment; these must be requested from the Lessor
5.3 A credit card must be deposited as security if the costs are covered
5.4 The rent and the booked services for long-term rentals (from 1 month) are to be paid monthly in advance, at the latest on the 1st working day of the month, to the Landlord by bank transfer (the Tenant shall bear the costs of the transfer) to the following account:

5.5 Credit card payment:
Payments are possible in exceptional cases with the following credit cards: American Express, Visa Card and Master Card.
The Tenant expressly agrees that the Landlord is entitled to charge any rent arrears that have not been paid by the move-out date to the credit card presented by the Tenant.
6. temporary use / use of the rented property
6.1 The Lessee rents for temporary use.
6.2 The subletting or other transfer of use of the apartment to third parties other than those named in the contract may only take place with the written consent of the Landlord.
6.3 Keeping animals is not permitted.
6.4 This is a completely non-smoking house. If smoking is nevertheless permitted in the apartment, an increased cleaning fee of at least € 500.00 (= net € 420.17 plus VAT currently 19% = € 79.83) will be charged so that the next tenant can move into a pleasant living environment.
Smoking at the windows and on the terraces is strictly prohibited except for the roof terrace. A fee of 500.00 euros will also be charged for non-compliance.
6.5 It is not permitted to hold parties in the room, in the house, in the corridors or on the roof terrace. An additional fee of 500 euros will be charged for non-compliance.
6.6 More than 2 BOOKED persons in the room are not permitted.
6.7 Persons from outside the hotel have no access to the building or the rooms.
6.8 Photographs and video shoots are only permitted with prior approval.
7. maintenance of the rental property
7.1 If damage to the property becomes apparent during the stay, the Tenant must notify the Landlord immediately.
7.2 The Tenant must treat the apartment with care.
7.3 The Tenant shall be liable to the Landlord for damage caused by breaches of the duty of care and notification incumbent upon him, in particular also if the rooms are insufficiently ventilated, cleaned, heated or inadequately protected against frost.
7.4 The inventory may not be removed.
8. shared use of communal facilities
8.1 Washing machines and dryers are available to the Tenant for a fee in the common rooms in the basement. These appliances are used at the Tenant’s own risk and peril.
8.2 The equipment provided by the Lessor must be treated with care and respect.
9. internet
9.1 Internet access via LAN / WLAN is included in the rental price. The landlord accepts no liability for the fact that an internet connection cannot be established if the network is overloaded.
9.2 The Tenant must ensure that the Internet is only used within the scope of what is permitted by law.
10. entry to the rental property by the landlord
10.1 The Lessor and/or its authorized representative may enter the property for important reasons after giving due notice.
11. return at the end of the rental period
11.1 At the end of the rental period, the apartment must be handed over clean and in the same condition as when the tenant moved in by 11.00 a.m. at the latest. If the apartment is not handed over in proper condition by the aforementioned time, a daily fee of at least € 250.00 (= net € 233.64 plus VAT currently 7% = € 16.36) will be charged. The tenant shall bear the costs of any subsequent cleaning that may be required.
11.2 The Tenant must compensate the Landlord for damage in and to the apartment, insofar as the Tenant is responsible for this damage.
11.3 The Hirer must replace any inventory damaged in the course of the booking or compensate for it with an appropriate amount of money, insofar as the Hirer is responsible for this damage.
11.4 If you move out outside the opening hours, proceed as follows:
- Close all windows
- switch off all electrical appliances except the refrigerator
- All waste must be disposed of in the garbage cans provided for this purpose
- place all the keys to the apartment on the dining table
- pull the apartment door from the outside
12. severability clause
Should one of the contractual provisions become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the invalid provision in economic and legal terms.
13 Place of jurisdiction and applicable law
- Munich shall be deemed agreed as the place of jurisdiction insofar as the requirements of § 38 ZPO apply to the contracting parties.
- In the case of disputes with legal persons from abroad within the EU, Article 22 No. 1 of the Brussels I Regulation also applies.
- German law shall apply exclusively.
